Terms of Service

Agreement

By using obxtd.com ("the Site"), you agree to these Terms of Service. If you do not agree, do not use the Site. These terms apply to all visitors, users, and anyone who submits content.

What OBXTD Is

OBXTD is a community-driven aggregator of restaurant specials, happy hours, live music, and events on the Outer Banks of North Carolina. We do not represent, endorse, or guarantee the accuracy of any listed venue, event, special, or promotion. All information should be verified directly with the venue before visiting.

Submitted Content

Your submissions

When you submit an event, special, image, or any other content to OBXTD, you grant us a non-exclusive, royalty-free license to display, modify, and distribute that content on the Site and in related promotional materials.

Accuracy and moderation

Submitted content is reviewed before publication, similar to how Wikipedia operates — anyone can submit, but submissions are reviewed for accuracy, relevance, and appropriateness before going live. We reserve the right to edit, reject, or remove any submission at our sole discretion.

By submitting content, you represent that:

  • The information is accurate to the best of your knowledge
  • You have the right to share the content
  • The content does not infringe on any third-party rights
  • The content is not misleading, defamatory, or harmful

Images

Images submitted via our photo upload feature are used solely to extract event or menu information using AI analysis. Images are processed and not permanently stored on our servers. Do not submit images containing personal information, faces without consent, or copyrighted material you do not own.

Content ownership

You retain ownership of content you submit. By submitting, you license us to use it as described above. If you believe content you own has been posted without authorization, see our Takedown Process below.

Takedown Process

If you are a venue owner, rights holder, or individual and believe content on OBXTD is inaccurate, unauthorized, or infringes your rights:

  1. Email legal@obxtd.com with subject line "Takedown Request"
  2. Include your name, contact information, and the specific content you want removed
  3. Describe why the content should be removed (inaccuracy, copyright, privacy, etc.)
  4. We will review and respond within 5 business days
  5. Valid requests will result in removal or correction within 48 hours of confirmation

For DMCA copyright claims, include a statement that you are the rights holder or authorized to act on their behalf, and that your complaint is made in good faith.

Premium Subscriptions

Some features (interactive map, 7-day lookahead) require a paid subscription. By purchasing a subscription:

  • You authorize us to charge your payment method via Stripe
  • Subscriptions are for the period selected (weekly, monthly, or seasonal)
  • We do not store your payment information — all transactions are processed by Stripe
  • Access expires at the end of the subscription period. To renew, simply purchase again

Google Maps

The Site uses Google Maps Platform to display maps and venue information. Your use of map features is subject to Google's Terms of Service at maps.google.com/help/terms_maps. Google's Privacy Policy applies to map interactions.

Stripe Acceptable Use

Payment processing is provided by Stripe. By making a purchase, you agree to Stripe's Terms of Service at stripe.com/legal and their Acceptable Use Policy at stripe.com/legal/restricted-businesses.

Prohibited Uses

You may not use OBXTD to:

  • Submit false, misleading, or defamatory content
  • Scrape or harvest data without written permission
  • Attempt to gain unauthorized access to any part of the Site
  • Submit spam, commercial solicitations, or irrelevant content
  • Impersonate any venue, person, or organization
  • Violate any applicable law or regulation

Account Termination

We reserve the right to terminate or suspend access to any account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Site ceases immediately. Provisions of these Terms that by their nature should survive termination will survive.

Disclaimers

The Site is provided "as is" without warranties of any kind. We do not warrant that venue information, hours, specials, or events are accurate, current, or complete. Always confirm details directly with the venue. We are not responsible for any loss or inconvenience resulting from reliance on information displayed on the Site.

Limitation of Liability

To the maximum extent permitted by law, OBXTD and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or any content on it.

Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law provisions.

Changes to These Terms

We may update these Terms at any time. Continued use of the Site after changes constitutes acceptance. We will update the date at the top of this page when changes are made.
